Massachusetts Governor Sends Transportation Bill Back


 Massachusetts transportation plan hits roadblock.

Update, 7.22.13: The Massachusetts House and Senate rejected the governor's proposed amendments to H 3535, and on July 19, Governor Patrick vetoed H 3535: "Today, with mixed emotions, I am vetoing the transportation finance bill." Whether or not the Legislature overrides his veto remains to be seen.

Massachusetts Governor Deval Patrick (D) thinks H 3535, the transportation finance bill sitting on his desk, needs more work. He handed it back to legislators with the message, "I cannot support this bill in its current form," and with several proposed amendments in the form of House Bill 3544.

The governor does not wish to remove the controversial provision to broaden the state sales tax to include computer services. However, he would delay the imposition of such a tax.

Changes

Gov. Patrick would like to see the following provisions included:

  • Increase the gas tax "if and to the extent the toll revenues are reduced."
  • Delay "by seven days the effective dates of the gas tax and computer system design services and software modification sales tax sections of the bill," in order to avoid retroactive taxation and time for both taxpayers and the Department of Revenue to implement these changes.

The governor has said he is "open to other funding mechanisms to make up for the lost revenues in 2017 but only to the extent they are equally responsible and certain."
