Colorado: Remote Retailer Reporting Requirements on Hold


 Colorado: although the use tax notification requirement is on hold, use tax may still be due.

The Denver District Court has granted a preliminary injunction against the Colorado remote sales and use tax notification reporting requirement. In response, Colorado Department of Revenue has made the following announcement:

“At this time, retailers are not required to comply with these reporting requirements.”

Nonetheless, Colorado purchasers remain liable “for the tax on any purchase on which sales tax was not collected.” Repeat, in bold: “customers are still required to file a Consumer Use Tax Return and pay the tax due.
